Our service terms, responsibilities, and important information about mediation.

1. Introduction

These Terms and Conditions govern your use of Console Family Mediation's services. By booking a session or using our services, you agree to be bound by these terms. If you do not agree, please do not proceed with booking.

2. Nature of Mediation

Our mediators act as neutral facilitators to help you reach your own decisions; we do not provide legal advice or represent either party. While mediation allows you to agree on proposals for financial or parenting arrangements, these outcomes are not legally binding until formalized. We strongly recommend seeking independent legal advice throughout the process to ensure your agreements are legally sound and properly recorded.

  • Mediation is not legal or financial advice. We are neutral facilitators, not advocates.
  • Mediation cannot be forced or used as evidence in court proceedings.
  • You may seek independent legal advice from a solicitor.
  • Agreements reached in mediation are not legally binding unless formalized through legal channels.
  • We cannot make decisions for you; we help you reach your own agreements.

3. Suitability and Eligibility

Mediation is not suitable in cases involving domestic abuse, significant power imbalance, or where one party is unable to participate safely. We reserve the right to decline or suspend mediation if suitability concerns arise. If safeguarding issues are disclosed, we may be legally required to refer to appropriate authorities.

4. Payment and Fees

Fee Structure: Fees are displayed on our Fees page and include VAT.

Payment Terms: Payment is due at the time of booking. We accept card payments and bank transfers.

Legal Aid: We do not offer legally aided mediation, however should you be eligible we can signpost you to an organisation that can offer legal aid.

Invoices: Invoices are available upon request for record-keeping.

5. Cancellation and Rescheduling

Cancellation Policy:

  • Cancellations made 7+ days before the session: Full refund
  • Cancellations made 48 hours to 7 days before: 50% refund
  • Cancellations made less than 48 hours before: No refund
  • No-shows without notice: Full session charge applies

Rescheduling: You may reschedule sessions with at least 7 days' notice at no charge.

6. Confidentiality

All information discussed in mediation sessions is strictly confidential. This confidentiality is protected by law.

Exceptions: We may be required to disclose information in cases involving:

  • Suspected child abuse or neglect
  • Serious risk to someone's safety
  • Court orders or legal requirements
  • Professional regulator inquiries

7. Code of Conduct

During mediation sessions, all participants are expected to:

  • Treat each other with respect
  • Refrain from threatening or abusive language
  • Participate in good faith
  • Not record sessions without written permission
  • Not attend sessions under the influence of alcohol or drugs

Failure to follow this conduct may result in session termination without refund.

8. Limitation of Liability

Console Family Mediation provides mediation services in good faith. We are not responsible for decisions made by participants based on mediation outcomes. It is an expectectation that you seek independent legal and financial advice before finalizing any agreements. We are not liable for outcomes, delays, or consequences arising from the mediation process.
